THE PERSONAL DATA WE PROCESS

Depending on your capacity, qualification, activity and relationship with our company, you provide us with personal information. This personal data that you actively provide to us, for example by filling in your details on our website, by filling in our forms or by communicating with us by telephone or in writing, is necessary to be able to help you.

Specifically for (future) au pairs and (future) host families, O-PAIR emphasizes that it only collects and processes the personal data that you share with us via the documents drawn up for this purpose, via conversations or other forms of communication. O-PAIR understands that it obtains far-reaching personal data from you via various channels, including information that the GDPR considers special or sensitive.

In summary, we collect the following (categories of) personal data:

  • Identification data (including personal identification data, identification data - other than the National Register number - issued by the government, electronic identification data)
  • Financial data (including financial identification, financial resources, solvency, professional activities)
  • Personal characteristics (including personal details and immigrant status)(au pairs only)
  • Physical data (physical descriptions) (au pairs only)
  • Lifestyle (including habits, lifestyle, details about travel and relocation, social contacts)(au pairs only)
  • Psychological data (psychological descriptions)
  • Family composition (including marriage or current cohabitation, details of other family members or family members living at home)
  • Hobbies and interests
  • Judicial data regarding convictions and sentences (mandatory due to migration) (only for au pairs)
  • Consumption data

  • Data on physical health, mental health, risk situations and risk behavior (au pairs only)

You are not obliged to provide your personal data, but you understand that the provision of certain services or cooperation may become impossible if you do not agree to their collection and processing.

PROCESSING PURPOSES AND LEGAL BASIS

AU PAIRS AND HOST FAMILIES

O-PAIR processes your personal data for the following purposes:

  • To be able to call or email you if this is necessary to carry out our services
  • To provide you with the opportunity to create an account
  • To provide services to you (au pair mediation). The purpose of this processing is in principle the execution of the agreement. In addition, we process personal data in the context of customer management and accounting.
  • O-PAIR also processes personal data because we are legally obliged to do so, such as data that we must have in our file for the au pair application (visa/residence permit procedure) due to our administrative obligation to the Flemish, Walloon and/or Federal government (see INFORMATION FROM AUTHORITIES).

As part of our services and activities, we collect and process personal data of the parties for whom we mediate, being (candidate) host families and (candidate) au pairs, if applicable their family members, references and other useful contacts.

To process the personal data you provide us, we always ask for your explicit consent. The other legal grounds for this processing are the execution of the agreement, compliance with legal and regulatory obligations and our legitimate interest.

DATA FROM AU PAIR AGENCIES, INTERMEDIARIES AND MEDIATORS

In the context of our services and activities, we collect and process personal data of contacts at au pair agencies, intermediaries and mediators, as well as of their employees, staff, appointees and other useful contacts. This is limited to identity and contact details, if applicable VAT number and account number.

The purposes of this processing are the execution of the agreement, the management of our correspondents/intermediaries and accounting.

The legal bases are the performance of the agreement, compliance with legal and regulatory obligations and/or our legitimate interest.

INFORMATION FROM CONTACT PERSONS AT GOVERNMENTS, EMBASSIES, TRAVEL AGENCIES, INSURANCE COMPANIES, MUNICIPALITIES, MIGRATION FLANDERS, WALLONIA, BRUSSELS, INTEGRATION & INTEGRATION AGENCY AND OTHER PARTNERS

In the context of our services and activities, we are in contact with governments, embassies, travel agencies, insurance companies, municipalities, migration Flanders, Wallonia, Brussels, Integration & Integration Agency and other contacts, their staff, employees, appointees and other useful contacts. We collect and process the data.

The purposes of these processing operations are the execution of the agreement and the management of our co-sponsors/intermediaries. The legal grounds are the execution of the agreement, the compliance with legal and regulatory obligations and/or our legitimate interest.

DATA FROM THIRD PARTIES, SO-CALLED OTHERS

We occasionally collect and process personal data from suppliers, useful contacts within our sector, network contacts, expert contacts, etc.

O-PAIR does NOT sell your data to third parties and only provides it if this is necessary for the execution of our agreement with you or to comply with a legal obligation.

The purposes of this processing are the interest of our activities and public relations. The legal basis is the performance of a contract and our legitimate interest.

THE RECIPIENTS OF YOUR DATA

For the purpose of processing your personal data, we grant access to your personal data to our employees, associates and appointees. We guarantee a similar level of confidentiality and protection by making contractual obligations enforceable towards these employees, associates and appointees, which are comparable to this Privacy Policy.

In order to fulfil our role as an intermediary, we share the personal data of (candidate) host families with (candidate) au pairs, au pair agencies, intermediaries and mediators. Conversely, we share the personal data of (candidate) au pairs with (candidate) host families. The exchange of data is always requested with the express consent of both the au pair and the host family.

In order to fulfil our assignment and possibly to comply (on behalf of our client) with legal obligations, we share personal data of (candidate) host families and (candidate) au pairs with governments, embassies, travel agencies, insurance companies, municipalities, migration Flanders, Wallonia, Brussels, Agency for Integration & Integration and other contact persons.

Certain personal data collected by us will be passed on to and possibly processed by external service providers, such as our IT and software supplier, website host and our accountant.

The employees, managers and/or representatives of the above-mentioned service providers or institutions and the specialized service providers appointed by them must respect the confidential nature of your personal data and may only use this data for the purposes for which it was provided. In order to guarantee this, the necessary agreements are concluded with these processors.

TRANSFER TO THIRD COUNTRIES

It is possible and even likely that one or more of the third parties mentioned above are located outside the European Economic Area (“EEA”) and are not on the so-called “white list” of countries which the European Commission has deemed to have adopted data protection legislation equivalent to European law.

O-PAIR does everything it can to protect your personal data and to build in appropriate safeguards. O-PAIR does this mainly (to the extent possible) to conclude contracts with the data controllers of the recipient based on the Standard Contractual Clauses drawn up and approved by the European Commission or the Belgian Data Protection Authority. In any case, O-PAIR always asks for your explicit consent for the transfer of your data to third countries.

HOW LONG WE KEEP YOUR DATA

The personal data are stored and processed by us for a period that is necessary in function of the purposes of the processing and in function of the (contractual or otherwise) relationship that we have with you. Personal data are in any case deleted from our systems after a period of five years after termination of the agreement or the last contact, except for the personal data that we are required to store for a longer period based on specific legislation.

WHAT RIGHTS YOU HAVE OVER YOUR DATA

In accordance with and under the terms of Belgian privacy legislation and the provisions of the GDPR, we inform you that you have the following rights:

  • Right to information: you have the right to know what information we collect from you, for what purposes, on what legal basis, how long we retain this data and to whom we may pass this information on. This privacy policy has been drawn up to comply with this right.
  • Right of access and inspection: you have the right to take note of the data we have about you free of charge and to determine what it is used for.
  • Right to rectification: you have the right to obtain correction of your incorrect personal data or to supplement incomplete personal data.
  • Right to erasure or restriction: You have the right to request us to erase your personal data or to restrict its processing in the circumstances and under the conditions set out in the General Data Protection Regulation.
  • Right to data portability: You have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format. You have the right to transmit this data to another controller.
  • Right to object: You have the right to object to the processing of your personal data for serious and legitimate reasons with the Data Protection Authority.
  • Right to withdraw consent: If the processing of personal data is based on prior consent, you have the right to withdraw this consent. These personal data will then only be processed if we have another legal basis for this.
  • Automated decisions and profiling: We confirm that the processing of your personal data does not include profiling and that you will not be subject to automated decisions.

Please note that O-PAIR is not obliged to comply with your request for access, correction, deletion or transfer. This for reasons specific to the performance of a legal obligation, the performance of the agreement or our legitimate interest, and this as long as this information is necessary for the purposes for which it was collected. We do everything we can to handle your personal data in a careful and legitimate manner in accordance with the applicable regulations.
